Planning Board minutes for Thursday July 13, 2017

  • Open meeting and take attendance.
  • The meeting opened at 7:02 p.m.
  • Members present: Stephen Enoch, co chair, Tom Sawyer, co-chair, Pat Salomon, Don Coburn, Roger Tryon.
  • Public present: Jeremia Pollard, Town Counsel, John Szablowski from Hume Lake Christian Camp, Hume’s attorney Alexandra Glover, Wendy and Jean Germain, and Eoin Higgins from the Berkshire Eagle.
  • Hume Lake Christian Camp remand re: Site Plan Review 4-9-17.
  • Town Counsel reported that he received the General Remand Order from the Land Court which allows the Planning Board to change and/or eliminate the conditions of the site plan review submitted 4-9-17. Town Counsel said that if the claim were resolved to Humes’ satisfaction they would dismiss the challenge to zoning they filed in response to the site plan review. Town Counsel stated that regardless of the vote of the Planning Board he will defend the towns’ right to site plan review if necessary.
  • Don Coburn made a motion to approve the site plan with no conditions and said that the Planning Board had exceeded its purview. Klein seconded the motion, which was up for discussion.
  • There was a lengthy discussion with regard to the conditions and the concerns with the camp. The motion to approve the site plan with no conditions was approved with 4 members in favor and 2 opposed.

IV.     The minutes from May 25 and June 8, 2017 were read and approved. The       minutes from June 22 were amended to reflect that John Szablowski from Hume attended the meeting, and approved as amended.

  • From Town of Great Barrington: Notice of Decision on Special Permit; to approve the request of Blackwater Realty Trust to increase the amount of impervious surface at 0 Maple Ave.
  • From the Town of Sandisfield: the Sandisfield Board of Selectmen will hold a public hearing on Monday, July 17, 2017 at 7:00 p.m. at the Town Hall Annex, 66 Sandisfield Rd., Sandisfield, MA. The public hearing is for a special permit under Section 5.B.7 of the Zoning bylaws to operate D’Andrea Gun Leather at Berkshire Homestead to include Federal Firearms License AKA FFL-1 which will include the sale and transfer of ownership of guns. The FFL will be in a separate dwelling on the property at 12 Silverbrook Road in Sandisfield.
